Maternity leave is the period of mandatory leave from work granted to female employees before and after the birth of her child.

The employee is entitled to 5 months of leave, usually 2 months before delivery and 3 months after delivery.

The law provides the possibility, subject to documentation issued by the medical specialist and FBK’s occupational health physician, to abstain from work 1 month before delivery and 4 months after delivery or 5 months after delivery (so-called flexibility).

The local health authority or local labor department may order, in cases where there is harm risk to the health of the mother and/or the child, early abstention from work.

The employee must submit two online applications to INPS (either independently with a “PIN operativo” or through an authorized party – e.g., CAF, i.e. tax assistance center):

1. Prior to the start of mandatory abstention from work with an indication of the expected date of delivery;

2. Within 30 days after the birth of the child with the date of birth.

We recommend strict adherence to INPS requirements as to the procedure and deadlines.
More information can be found on theINPS page.

⇒ WHAT TO DO

Once the applications have been submitted, INPS issues the receipt and data summary, which must be attached (with a .zipper file) to the event in INAZ (the event is called “MAT OBBLIG Mandatory Maternity leave”).

The birth certificate should be attached to the event in INAZ along with the documentation issued by INPS.

Parental leave is an optional period of abstention from work granted to parents to care for a child in his or her early years.

Parental leave is granted to natural parents, who are hold a permanent employment contract, for a total of 10 months between both parents, which can be extended to 11 months if the father requests at least 3 months (including no-consecutive periods of time).

INPS compensates the first 6 months at 30 percent; the Foundation supplements the first 30 days (22 days if non-consecutive periods) at 100 percent pay.

Workers should apply online through the INPS website (either ont their own with a “PIN operative” or through an authorized party – e.g., CAF,  i.e. tax assistance center).

We recommend strict adherence to the procedure and deadlines required by INPS.

More information can be found on theINPS page.
