These general conditions define and regulate the methods and terms by which the Bruno Kessler Foundation (hereinafter the Foundation) makes available the wireless network service, called FBK-Guests.
- Description and characteristics of the Service
- These general conditions concern the rules for using the Internet service provided by the Foundation via FBK-Guests. This service is free and consists of a package of features inherent to the use of the internet in wireless mode (Wi-Fi). In particular, the FBK-Guests service allows wireless internet connection to all those with laptops, smartphones, tablets or PDAs equipped with a Wi-Fi network card.
- The Bruno Kessler Foundation reserves the right to expand and modify the range of features offered within the Service.
2. Service Provision
- The User can use the Service by following the connection instructions published on the web page https://howto.fbk.eu/en/documenti/guide-to-accessing-wifi-networks/. It is expressly excluded the possibility of transferring its use to third parties, free of charge or for a fee, temporarily or permanently, without the written consent of the Foundation.
- The Foundation reserves the right to modify the characteristics of the Service's functionalities or to delete some of them. The costs of connection to the Service, where envisaged, are borne by the User.
3. Commitments and obligations of the User
- The User is obliged to use the Service with respect for third parties and in compliance with all laws, regulations in force, and the regulations published on the website https://howto.fbk.eu/en/it-department/networks-and-the-internet/.
- The User guarantees that any material entered into the network does not violate copyright or other intellectual or industrial property rights. The User acknowledges that it is prohibited to use or allow others to use the Service for acts against morality or public order, or for the purpose of disturbing the peace of others, damaging, violating or otherwise attempting to violate the secrecy of correspondence. The User undertakes not to enter information on the network, through the Service, that may present forms and/or content of a pornographic, obscene, blasphemous or defamatory nature. The use of the Service to commit or facilitate the commission of crimes of any kind is prohibited. The User will not use, and will take every precaution to ensure that third parties do not use, the Service to make communications that cause damage or disturbance to users or telecommunications operators, or that violate the laws or regulations in force, or are contrary to public order. Therefore, by way of example, it will not carry out, nor allow others to carry out, the sending of unsolicited commercial communications (spamming), the mass sending of unsolicited and unsolicited communications to individual e-mail addresses/network identifiers (mail bombing), the carrying out of unauthorized attempts, successful or not, to access any addresses or computer resources not belonging to the User (spoofing). The User also undertakes to adopt adequate tools for protection against computer viruses.
- The User undertakes to use the Service in compliance with the Conditions and Rules of Use of the Service and to follow the technical instructions provided by the Bruno Kessler Foundation.
- The User undertakes not to allow the use of the Service (even partial) for any reason to third parties, and will be responsible for any damage deriving from the use of his credentials by them.
- The User is obliged to hold the Foundation harmless from any loss, damage, liability, cost, charge, or expense, including legal fees, arising from the violation referred to in the previous points or from actions, claims and exceptions asserted by third parties against him, in dependence or in connection with breaches by the same to the obligation of the Conditions and Rules of the Service, or in any case to acts that fall under his own responsibility.
4. Confidentiality
- The User acknowledges that the Bruno Kessler Foundation only identifies an e-mail address, in no way associated with the personal data of the owner, and also accepts the existence of an electronic register that monitors the operation of the Service (Log) and is compiled and kept by the Foundation in accordance with the law. The content of the Log is absolutely confidential and may be shown only and exclusively to the competent Authorities, upon formal request.
5. Suspension or other malfunctions in the provision of the Service
- There may be interruptions, suspensions, delays or malfunctions in the provision of the Service.
- The User acknowledges that the Foundation will not be liable for damages deriving to the User or to third parties as a result of said interruptions, suspensions, delays or malfunctions of the Service, except in the case of willful misconduct. In this case, however, the Foundation will activate to minimize any inconvenience to the User, possibly providing the necessary information and/or, if possible, adequate notice. The User acknowledges that the Foundation will also not be liable for any damages deriving to the User or to third parties in the event of changes and/or maintenance that are not programmed or not foreseeable or technically necessary, or programmed and foreseeable but reported with adequate notice.
- In the event of changes in the Technical and Regulatory Conditions that prevent the normal provision of the Service, the Foundation will have the right to suspend the provision of the Service itself at any time.
6. Communications
- Any communications from the User regarding these conditions and rules of the Service must be addressed to: Fondazione Bruno Kessler at the registered office in Trento, Via S. Croce 77 (38122), by registered mail with return receipt.
7. Applicable law. Court of elected domicile. Out-of-court dispute resolution procedure
- These terms of use are governed by Italian and Community law, where applicable. The current regulations apply for anything not expressly provided for in this document.
- For any dispute concerning the validity, effectiveness, interpretation and execution of these terms of use, the competent body is the Court of Trento.
